Cancellation & Refunds Policy:
Sometimes, unavoidable things happen which may mean that a client would need to cancel or reschedule their appointment, and here at D-Restricted Ltd, I understand this.
Should a service-user wish to cancel their appointment at any point, they are encouraged to do so at their earliest convenience. This can be done using your 'Patient portal' that you created when you made your initial consultation, or directly through contacting D.Warren. Should you rschedule your appointment more than 3 times then the booking fee will not be transferred and that fee will remain outstanding.
D-Restricted Ltd usually have more than one last minute emergency referral that commonly need to make an urgent appointment; who may appreciate an earlier time slot should one become available.
Unfortunately, D-Restricted Ltd are unable to refund your deposit, unless plans are in place to reschedule the original consultation. In this instance the booking fee is not lost, and is transferred to apply to the deferred consultation. In the event that less than 4 hours notice is given, the deposit and full fee is lost.
If a service user is running late for their appointment, service users are encouraged to call D-Restricted Ltd (07910608179) to discuss their options. If the estimated time of arrival is in excess of 10 minutes later than the original scheduled time of the appointment, the consultation will need to be cancelled and the full fee is lost.
Should D-Restricted Ltd need to cancel, D-Restricted Ltd will do so as early as possible and do my very best to rearrange the appointment with minimal delay, or refund your full fee so a service user has the option to choose an alternative provider if necessary (www.tongue-tie.org.uk/find-a-practitioner).
In the event of a sudden serious illness or critical accident where D-Restricted Ltd would be unable to contact you, or in the event of my death, all appointments would be cancelled by a third party (also healthcare professional who is DBS checked) and arrange a full refund as able. Of course, the nominated person will need to gain access to your name, telephone number and payment details in order to do so and access to this is protected so may take a while for them to access this information legally. The Association of Tongue-Tie Practitioners (ATP) would be made aware to remove my name from their approved listings, and notices would be put on both my website and social media pages.
Patient records will still be available should you wish to view them for 25 years post division.
If in the event D-Restricted Ltd has deceased, please contact Information Commissioner’s Office (ICO) (details below) for details of any successor who will be able to arrange this for you ensuring you can provide the required formal identification.

YTM® Tool Method Programmes – Programme Cancellation and Refund Terms
These terms apply specifically to the YTM® Tool Method programmes offered by D-Restricted Ltd® and should be read alongside the above D-Restricted Ltd® Cancellation Policy above.
The D-Restricted Ltd® Cancellation Policy applies to cancellations generally. The terms below provide additional provisions specific to the YTM® Tool Method programmes.
YTM® Tool Method programmes
D-Restricted Ltd® offers two YTM® Tool Method programmes:

YTM® tool method: 'Tension & Tone'
-
YTM® tool method: 'Tongue-tie, Tension & Tone'
Both programmes consist of six sessions and are paid for in full in advance at the point of booking the programme package online.
A £30 booking fee is included within the programme payment and is non-refundable.
If the programme is cancelled, payment for unused sessions may be refunded where at least 24 hours' notice is provided before the next scheduled session.
Sessions that have already been attended are non-refundable.
Any refund due will be calculated according to the programme terms, taking into account the non-refundable booking fee and, where applicable, the YTM® Tool provisions below.
Participation in either programme is goal-led; however, no particular outcome, result or achievement of a specific goal is guaranteed.
YTM® Tool
The YTM® Tool is included as part of the YTM® Tool Method programmes and has a RRP value of £75.
The YTM® Tool is subject to the separate YTM® Tool Policy provided by D-Restricted Ltd®, which sets out the manufacturer's change-of-mind return requirements, hygiene provisions, limited manufacturer warranty, reporting of possible faults and applicable statutory consumer rights. The policy is found below HERE.
The YTM® Tool must be treated in accordance with that policy and the supplied product instructions.
For the purposes of a programme cancellation or refund:

where the YTM® Tool remains eligible for return under the YTM® Tool Policy, the Tool will be dealt with in accordance with that policy;
-
once the hygiene seal has been broken, the Tool cannot be returned for change of mind and the £75 Tool cost is non-refundable;
-
where the Tool is non-refundable, the £75 Tool cost will be deducted from any programme refund otherwise due.
Nothing in these programme terms limits statutory consumer rights where the YTM® Tool is faulty, unsafe or not as described.
YTM® Tongue-tie Tension & Tone programme
The £220 Session 2 fee for the YTM® Tongue-tie Tension & Tone programme includes tongue-tie division.
If, during Session 1, it is identified that a surgical release is not required, the £170 difference between the YTM® Tongue-tie Tension & Tone programme and the YTM® Tension & Tone programme will be refunded to the original payment method. The programme will then revert to the YTM® Tension & Tone programme, with the remaining sessions continuing under the terms applicable to that programme.
Relationship between the policies
These terms are an add-on to, and do not replace, the D-Restricted Ltd® Cancellation Policy.
The YTM® Tool is additionally subject to the separate YTM® Tool Policy. The YTM® Tool Policy applies specifically to the Tool, including its return, hygiene, warranty, fault and statutory-rights provisions.
Where these YTM® Tool Method programme terms contain a specific provision relating to programme cancellation or refunds, that provision applies to the programme.
Where a matter is not specifically addressed in these YTM® Tool Method programme terms, the D-Restricted Ltd® Cancellation Policy applies.

The £220 Session 2 fee includes a tongue-tie division (if a surgical release is identified as not required in session 1, then the difference in fees of £170 is refunded to the original payment method and the program revers to 'Tension & Tone' program).

Oral Tools: Use, Safety and Returns Policy
D-Restricted Ltd® may supply a range of oral tools and resources that may support oral health, oral function, oral strength and related therapeutic activities. These include the YTM® Tool, Myo Munchee Bebe, Tongue-Tie Home tool, 'O' Ball and/or other products.
This policy explains the intended use and safe handling of these products, applicable returns conditions, manufacturer’s warranty arrangements and the process for reporting a product concern. Product-specific requirements are identified where they differ.
1. Intended use and safety
1.1 General safety requirements

Each product must be used only for its intended purpose and in accordance with the manufacturer’s instructions, age recommendations, safety warnings and cleaning and storage guidance.

Where a product is intended for use under the guidance of a trained practitioner, it must be used in accordance with that guidance. More independent use should only take place when appropriate and when the user or supervising adult understands the correct technique.
-
Products must not be modified, used for an unintended purpose or subjected to handling or forces that could damage them or create a safety risk.
-
The user or supervising adult must inspect the product before use and, where appropriate, after use. Stop using any product that becomes damaged, weakened or otherwise unsafe.

Products intended for infants and children must be used in accordance with the manufacturer’s age and supervision requirements. An adult must supervise use whenever required by the product instructions and the child’s developmental abilities.

Keep products and detached or damaged components away from children and animals where they could present a choking, swallowing or other safety hazard. If any part may have been swallowed or inhaled, seek urgent medical advice.

Cleaning, disinfection and sterilisation requirements vary between products. Do not assume that a product is suitable for boiling, chemical disinfection, autoclaving or any other cleaning method unless the manufacturer specifically confirms this.
1.2 YTM® Tool

The YTM® Tool is manufactured by Myofunctional Therapy UK Ltd and retailed by D-Restricted Ltd®. It is intended for guided use with soft orofacial tissues only.

The Tool must be used under the guidance of a practitioner trained in the YTM® Method and in accordance with the supplied product instructions.
-
The patient should use the Tool more independently only when the trained practitioner is satisfied that the patient understands and can follow the correct technique.
-
The YTM® Tool is not a chewing device, mouthguard or bite-training device. It must not be bitten, chewed, clenched, used against teeth or subjected to excessive pressure.

The user or supervising adult must inspect the Tool before and after every use.
-
Stop using the Tool immediately if it becomes cracked, torn, split, deformed, weakened or otherwise damaged.
-
Keep damaged pieces safely away from children and animals. If any part may have been swallowed or inhaled, seek urgent medical advice.
1.3 Myo Munchee Bebe
The Myo Munchee Bebe is a prescription-only product. It must only be supplied in accordance with applicable prescription requirements and used in accordance with the manufacturer’s instructions and relevant professional guidance.
1.4 Other tools and resources
Other products supplied by D-Restricted Ltd®, including the Tongue-Tie Home tool, O Ball and other resources intended to support oral health, oral function or strength, must be used in accordance with their specific intended purposes and manufacturer’s instructions.
The safety requirements in section 1.1 apply to these products alongside any additional product-specific instructions or warnings.
2. Change-of-mind returns
2.1 YTM® Tool and Myo Munchee Bebe
The following conditions apply to change-of-mind returns for the YTM® Tool and Myo Munchee Bebe.

These products are oral products supplied in sealed packaging for health and hygiene reasons.
-
Where either product is purchased online, you may normally cancel within 14 days of receipt and then return it within a further 14 days, provided the applicable statutory conditions are met.
-
A change-of-mind return will only be accepted if the hygiene seal remains intact and the product is unused, unopened and in its original packaging.
-
Where a product is sealed for health protection or hygiene reasons and is unsuitable for return once unsealed, the statutory cancellation right may be lost when the seal is broken.

This restriction does not affect your statutory rights where a product is faulty, unsafe or not as described.

Contact diana@tongue-tie.info before making any return. Do not send a used or damaged product unless written return instructions have been provided.

You are responsible for change-of-mind return postage where permitted by law. D-Restricted Ltd® is responsible for reasonable return costs where a product is confirmed as faulty and the law requires these costs to be met by the retailer.
2.2 Other tools and resources
Change-of-mind returns for other tools and resources are subject to the applicable statutory cancellation rights and any relevant product-specific hygiene restrictions.
Customers should contact diana@tongue-tie.info before returning a product. Any return must follow the instructions provided by D-Restricted Ltd®.
3. Limited manufacturer’s warranty
3.1 YTM® Tool and Myo Munchee Bebe
The YTM® Tool and Myo Munchee Bebe include a limited eight-week manufacturer’s warranty beginning on the date the product is delivered to the patient or end user.

The warranty covers verified defects in materials or manufacture arising during correct and intended use. It is not a lifetime warranty.

Breakage within eight weeks does not automatically mean that the product has a manufacturing defect. Each claim will be assessed using the available information and evidence.

The manufacturer’s warranty does not cover biting, chewing, clenching, excessive pressure, use against teeth or other hard structures where contrary to the intended use, accidental damage, cuts, punctures, tearing, misuse, unsuitable cleaning, disinfection or storage, including incorrect autoclave settings where applicable, unauthorised alteration, normal wear and tear, or failure to follow practitioner guidance and product instructions.

This limited manufacturer’s warranty is additional to, and does not replace or restrict, your statutory consumer rights. Statutory rights may continue after the eight-week warranty has expired.
3.2 Other tools and resources
Other tools and resources supplied by D-Restricted Ltd® are subject to the applicable manufacturer’s warranty, if any, and any relevant product-specific terms. The eight-week manufacturer’s warranty described in section 3.1 does not automatically apply to other products.
Nothing in this policy removes or limits any statutory consumer rights.
4. Reporting damage or a possible fault
D-Restricted Ltd® is the retailer responsible for handling your statutory consumer rights relating to products purchased from us.
If a product becomes damaged or appears faulty, stop using it and contact D-Restricted Ltd® at diana@tongue-tie.info or 07910 608179.
To help assess the concern, please provide:

Your name and contact details.

Your dated receipt or other proof of purchase.

Photographs or video showing the concern, where possible.

The product or batch number, where available.
-
A description of how the product was being used.

The date the concern was first noticed.
For hygiene and safety reasons, we do not accept unsolicited physical returns of used or broken oral tools. The concern will normally be assessed initially from photographs, video and the information supplied. If examination is required, suitable return or collection instructions will be issued.
Where the evidence suggests a possible manufacturing defect, D-Restricted Ltd® will refer the concern to the relevant manufacturer where appropriate.
For the YTM® Tool, patients may also report a product safety concern directly to Myofunctional Therapy UK Ltd at info@mftuk.uk.
The assessment process does not remove or delay any statutory rights or remedies to which you may be entitled as a consumer.
Your statutory rights
Nothing in this policy limits your statutory rights under UK consumer law. Where a Tool is faulty, unsafe or not as described, the appropriate remedy may include repair, replacement, a price reduction or refund, depending on the circumstances and applicable law.
